Conditions of sale

These general terms and conditions of sale apply to products and services marketed under the brand name Vigixx and provided by BKS Electronique SAS with a capital of €60980, registered in the RCS of Grenoble (France) under number B 330 828 104 with its registered office at 20, Rue Aristide Bergès - Z.I. des Iles – 38800 Le Pont de Claix – France

1. Payments

Payments are made on order through www.vigixx.com. Exceptions to this rule may only be validated after having received a written agreement from BKS Electronique SAS' sales department.

2. Prices

The prices of the products on the website www.vigixx.com are indicated in Euros excluding taxes and precisely determined on the pages dedicated to the products. Any invoice issued to the order of a customer, located in a country of the European Union other than France, will be excluding VAT provided that the buyer communicates, at the time of ordering, its intra-Community VAT number to BKS Electronique.

3. Withdrawal

The client has a period of 30 days to exercise his right of withdrawal without having to justify reasons. The shipping costs for the initial shipment of the product as well as the return costs remain with the customer. In the event of a withdrawal, the customer undertakes to inform BKS Electronique in writing before returning the goods. In the event of a partial return or if the returned product is damaged, BKS Electronique reserves the right not to refund the entire amount due. As the value of the initial subscription is not recoverable, in the case of a withdrawal, this amount will not be refunded.

4. Warranty

All products marketed under the brand name Vigixx are guaranteed for the legal term of 2 years from the date of delivery. The warranty is not applicable in the case of product deterioration due to vandalism or improper handling by the user.

5. Intellectual property

All information subject to intellectual property rights (image, video, text, etc.) is and remains the exclusive property of BKS Electronique SAS. No assignment of intellectual property rights is granted through these CGV. Any reproduction in whole or in part, modification or use of these objects for any reason whatsoever is strictly prohibited.

6. Disclaimer

Fencefox is an electric fence monitoring device. This device is intended to warn the user in case of a defect on its electric fence. However, responsibility for the integrity and proper functioning of the fence cannot be passed on to the manufacturer or distributor of the Fencefox device. The user is solely responsible for his electric fence. No electrical equipment being protected from breakdown, vandalism or defect due to misuse, the use of a Fencefox device alone does not eliminate the need for regular checks of the fence to ensure its integrity and perfect operation. In addition, any handling of a high-voltage fence requires special precautions. Always comply with the safety instructions mentioned in the operating manual of your Fencefox device. Be sure to always follow the safety recommendations of your energiser’s manufacturer.
Under no circumstances can BKS Electronique SAS be held liable for a fluctuating Sigfox communication network resulting in poor quality communication between a Fencefox device and the database.
The customer is responsible for ensuring that there is sufficient network coverage in the area in which he wishes to use his FenceFox device.

7. Privacy

In application of the French and European laws in force, it is recalled that the personal data requested from the customer are necessary for the processing of his order, for the drawing up of invoices, and customer monitoring for technical support purposes, in particular. This data will not be shared with any third party. The customer has, in accordance with the national and European regulations in force, a right of permanent access, modification, rectification and opposition concerning the information concerning him. This right may be exercised at any time by sending an e-mail to contact@vigixx.com, specifying the purpose of the request. The data entered by the customer on www.vigixx.com in order to place an order is deleted on the site’s servers 4 weeks after the order is issued by the customer. BKS Electronique SAS keeps the data necessary to manage the order on a local database (not accessible via the Internet) for the time required for the processing specified above (that is to say at least during the entire term of subscription) or until request of their deletion by their rightful owner.

8. Acceptation

Any order placed by the customer implies acceptance by the latter of the present general conditions of sale which prevail over any conditions of purchase of the latter which have not been expressly accepted by BKS Electronique SAS.

9. Modifications

BKS Electronique SAS reserves the right to modify these general conditions.

10. Applicable right

These general conditions of sale are subject to French law. Any dispute relating to these general conditions of sale which could not be settled amicably will be the exclusive jurisdiction of the Courts of Grenoble (France).

These terms and conditions of sale have been translated into German and English. In the event of a dispute concerning these general conditions of sale, the content of the French text shall prevail.
